Membership Terms and Conditions

 

1. Acceptance & Commencement
1.1. The acceptance of Blue Tree Membership (“Membership”) is at the sole discretion of the Blue Tree Management (“Management”), and Management reserves the right to refuse a Membership at any time without explanation or reason.
1.2. Blue Tree Members (“Members”) are obliged to read the Rules and Regulations of the Blue Tree Project upon joining the Membership Programme(s) herein, and Members understand that by activating their Membership, they have agreed and accepted to the Membership Terms & Conditions (T&C) herein, which are subject to change from time to time at the sole discretion of the Management.
1.3. When an Applicant has signed the T&C, and Blue Tree has received the full Annual Payment and Membership Fee (‘Membership Fee’), the applicant shall become a Blue Tree Member, and become subject to the T&C and the Rules and Regulations of the Blue Tree Project.

2. Cancellation
2.1. Management has the sole discretion and right to suspend and/or unilaterally terminate without notice to the Member, and with immediate effect any Member for breach of the Blue Tree Rules and Regulations, Blue Tree Code of Conduct and T & C which are subject to change from time to time at the sole discretion of the Management.
2.2. Any Membership which is terminated for any reason shall forfeit all fees, payments, rights, benefits and privileges to the Membership Program from the date of termination. All Membership Fees are non-refundable, and no Membership shall be entitled to a refund for any reason at anytime.
2.3. The use of a Membership Card by any person other than the member will result in immediate termination and cancellation of Membership, and forfeiture of Membership Fees.

3. Limitation of Liability
3.1. Management cannot be held responsible for any service, equipment, or recreational facilities not available in the Blue Tree Project for whatever reason.
3.2. Management has the sole discretion and right to make alterations to the Blue Tree Project, close attractions, alter the membership program without notice to the Member.
3.3. Management cannot be held liable for any losses directly or indirectly related to the activities listed in in this clause.
3.4. Vehicles left in the car park are solely at the car owner’s risk. Management accepts no liability for loss or damage to property or cars of Members or guests on Blue Tree premises.
3.5. All Members and Guest of Members agree to act at all times in a safe and prudent manner, so as not to endanger him/herself or others while entering the Blue Tree Project and using the Recreational Facilities.
3.6. Member or Guest of a Member make the voluntary choice to use the Recreational Facilities and participate in the activities in the Blue Tree Project, and therefore they acknowledge that doing so can involve dangerous or hazardous activities, and they are doing so at their own risk. All Members or Guest of Members agree to hold harmless, and expressly disclaim responsibility against the Management for whatever reason.
3.7. Members who are pregnant or suffering from any disabilities are advised to consult a physician prior to visiting the facilities of the Blue Tree.

4. Membership Cards
4.1. Membership cards remain the property of Blue Tree and must be returned to Blue Tree upon cancellation.
4.2. Membership Cards are valid for the holder of the Membership only and are not transferable.
4.3. Any member who loses his card may apply for a replacement, for which a charge will be levied accordingly.

5. Guests of Members
5.1. Members are solely responsible for the actions and conduct of their guests at all times and must ensure Guests comply with the T&C and the Rules and Regulations of the Blue Tree Project.
5.2. Guests of Members will be admitted at the sole discretion of the Management and Management reserves the right to refuse access to the Blue Tree Project of a Guest for any reason.

6. Contact Details
6.1. Members are required to give written notice to Blue Tree of any change of contact details. Failing such notice, all communications shall be assumed to have been received by the member within five (5) days of mailing to the last contact details notified to the Blue Tree.
6.2. Management allows one Membership name change per annum for a transfer fee of THB 5,000 THB.
6.3. Lifetime Memberships are transferable, for a transfer fee of THB 5,000 THB.

7. Discounts
7.1. Member discounts cannot be applied together with other discounts, promotions and/or offers.
7.2. Members are required to present a Membership Card at the ticketing office upon entering Blue Tree and at the time of ordering at Blue Tree F&B outlets and facilities to avail discounts.

8. Opening Times
8.1. Normal hours of operation on normal working days and on official holidays are at the discretion of Management and are subject to change from time to time without notice to the Members.

9. Use of Facilities
9.1. A Member is entitled to use Blue Tree facilities providing always that Blue tree may at any time withdraw all or part of its facilities for any period or periods and with notice, where practicable, in connection with any cleaning, repair, alteration, maintenance or security work or for reasons beyond the control of Blue Tree.

10. Social Activities
10.1. Management reserves the right at any time without prior notice to set aside facilities and space for events, exhibitions or other social activities.

11. Personal Belongings
11.1. Personal belongings are brought onto Blue Tree’s premises at the member’s risk and Blue Tree does not accept liability for any loss or damage to such items. For security reasons Members and Guests are advised to keep personal belongings and valuables close-by or within a locker.

In signing the Membership Terms and Conditions herein, you also agree to the Blue Tree Rules and Regulations, Terms and Conditions, Blue Tree Code of Conduct and the General Waiver.
